Article 1 – General Provisions

Access to the website source-of-youth.com is free and open, with no prior registration or account creation required.
Source Of Youth Manufacture edits and administers the e-commerce website source-of-youth.com. These General Terms and Conditions of Sale (the “Terms”) apply exclusively to sales of products and services made on source-of-youth.com.

Placing an order for one or more products/services and selecting/confirming a payment method during checkout implies prior review of these Terms and automatic, irrevocable, and unconditional acceptance by the customer.

Accordingly, the customer acknowledges that their agreement does not require a handwritten signature, insofar as the order is placed online. No special condition shall prevail over these Terms unless formally accepted in writing by Source Of Youth Manufacture. If Source Of Youth Manufacture does not invoke any provision of these Terms at a given time, this shall not be construed as a waiver of its right to invoke it later.

Article 2 – General Description of Products and Services

In accordance with Article L111-1 of the French Consumer Code, Source Of Youth Manufacture presents on its website the characteristics of products and services offered for sale so that customers can make an informed purchase.

The online catalog describes, in particular: specifications, illustrations and dimensions, product descriptions, service modalities, and where applicable, the service provider. Customers may contact Source Of Youth Manufacture by phone or email for additional information.

Source Of Youth Manufacture may modify products/services without prior notice.
The choice and purchase of any product/service is the sole responsibility of the customer. Inability to use a product (e.g., incompatibility with the customer’s equipment) cannot give rise to compensation or cancellation unless otherwise provided herein. Product photos/graphics are illustrative and may be updated as information is received. If a supplier changes a product, its online representation will be updated as soon as we are informed.

Article 3 – Sales Process

For each item, the catalog specifies the applicable price. By ordering a product/service, the customer agrees to purchase at the price displayed at the time of order. Placing an order implies an obligation to pay.

Article 4 – Prices and Delivery Fees

Prices shown on source-of-youth.com are in Euros (EUR), all taxes included, excluding any delivery fees.
Delivery fees, if any, are borne by the customer and added to the product/service price. They vary according to the number and type of products ordered and the destination.

Before final order submission, the customer is always informed of applicable delivery fees. Selecting and validating a payment method implies acceptance of the total amount due, including delivery fees. Delivery fees cannot be used to contest the order after final submission.

Article 5 – Placing an Order

Any order placed on source-of-youth.com entails an obligation to pay by the customer. Orders are placed online by following the checkout process. Orders are irrevocably binding on the customer.

Source Of Youth Manufacture confirms receipt of each order via email. When the order leaves our warehouse, the customer is notified by email. We recommend customers archive or print a copy of the order confirmation until receiving the final invoice.

As part of order verification and acceptance, Source Of Youth Manufacture may request additional supporting documents. The order will be validated only upon receipt and verification of these documents. Delivery timelines may be affected by delays in receiving such information. If the documents are not provided, Source Of Youth Manufacture reserves the right to cancel the order.

Article 6 – Availability

Product/service offers are valid while stocks last. Availability information is updated during business hours and given for guidance only. The “Available” mention indicates availability in supply and not guaranteed physical presence in the company’s warehouse.

For items not in our warehouse, offers remain valid subject to supplier availability. In line with the French Consumer Law of 17 March 2014, manufacturers must provide, within two months, to sellers or repairers (here Source Of Youth Manufacture) the spare parts necessary to repair or replace products.

Availability indications are provided to customers based on supplier updates. As these come directly from suppliers, errors or changes are beyond our control. In the event of unavailability, customers will be informed by email, letter, or telephone as soon as possible and may then request cancellation or exchange.

Article 7 – Invoicing

After order validation, a detailed invoice is sent to the customer by post or electronically (PDF by email).

Article 8 – Payment Methods and Security

The full amount (products/services plus delivery fees) is payable by bank card or any payment method offered at checkout on source-of-youth.com. An order is concluded upon receipt of order confirmation. For each order, the customer must provide the required information as indicated online. No order will be accepted/confirmed until payment details have been provided and validated.

Online card payments are secured by SSL encryption, a widely used global standard.

Article 9 – Payment Default

In case of non-payment—e.g., bank refusal or opposition by the customer—before or after the transaction, Source Of Youth Manufacture may terminate the sale by operation of law, without notice or delay, and may, at the customer’s expense, require return of the product. We may refuse to deliver or honor any order from a customer who has not fully settled a previous order or with whom a dispute is ongoing.

Article 10 – Product Delivery Modalities

Delivery is made by handing the product to the customer at the address indicated to Source Of Youth Manufacture. All deliveries are tracked. Upon hand-over by the carrier/postal service, a delivery note may require the customer’s signature. The customer must check the condition of packaging upon delivery and record any damage on the carrier’s delivery note and notify Source Of Youth Manufacture.

Article 11 – Delivery

Delivery times depend on the items ordered and do not exceed 30 days after conclusion of the contract. For multi-item orders, the overall delivery time is the longest of the items. The stated delivery time is based on our service providers’ commitments and our contractual relationships with them and with the customer.

Pursuant to Article 138-2 of the French Consumer Code, the customer may cancel the sale by letter or email if the delivery date or performance date is exceeded by more than 7 days, provided the delay is not due to force majeure. In any case, timely delivery/performance presupposes full payment of the price, delivery charges, and—where applicable—submission of any requested supporting documents (see Article 8).

Shipment is initiated by Source Of Youth Manufacture after full receipt of payment. In case of delay compared with the initial date, the customer should notify us in writing, so that we may improve service and resolve any issue as quickly as possible. If the product is located during this period, it will be immediately re-routed to the customer or to the designated recipient. If not found, we will reship at our expense. If the product is no longer available, Article 6 applies. In case of an exchange, delivery costs are borne by the seller.

Article 12 – Delivery Errors or Anomalies

In case of anomaly or error upon delivery (damage, broken products, damaged parcel) and/or non-conformity in nature or quality compared with the delivery note, the customer must:

  • Record handwritten reservations on the delivery note with signature (to be given to the carrier at delivery), and

For delivery error or exchange, the product to be exchanged must be given back to the carrier complete and in its original packaging. Subject to availability, the product will be exchanged or refunded if unavailable. Any claim not made in accordance with the above cannot be taken into account and releases Source Of Youth Manufacture from all liability. Exchange costs are covered by Source Of Youth Manufacture, except where the returned product does not match the customer’s initial declaration.

Article 13 – Right of Withdrawal

In accordance with Articles L.121-16 et seq. and L.121-21 of the French Consumer Code, customers have 14 clear days from delivery to notify Source Of Youth Manufacture of their withdrawal.

The 14-day period runs from receipt for goods or acceptance for services. If the 14-day period ends on a Saturday, Sunday, or public holiday, it is extended to the next business day. Customers then have 14 days from their withdrawal notice to return the product complete and in its original packaging for exchange or refund (product price only), without penalties or need to state reasons.

Source Of Youth Manufacture will accept exchange/refund only if all of the following conditions are met:
a) The return is made within the legal time limit (postmark as proof).
b) The product is returned in intact original packaging.
c) The product has not been opened and/or used.
d) Postal returns must be sent with tracking (registered with acknowledgment or equivalent). Otherwise, loss in transit cannot be covered and will be the customer’s sole responsibility.
e) Any product that is damaged or whose original packaging is deteriorated will not be refunded or exchanged.

Refunds may be made by bank check or bank transfer (with the customer’s agreement) or, by default, via the same payment method used by the customer. Refunds are processed within 14 days after sending the receipt confirmation to the customer.

In the event of lawful withdrawal and strict compliance with the above conditions (notably Article 13 and Article L221-23 of the French Consumer Code), return shipping costs are borne by the customer.

Article 14 – Transfer of Title and Risk

Title and risk transfer to the customer upon delivery (date appearing on the delivery note).

Article 15 – Warranty and After-Sales Service

In compliance with Articles L.111-1, L.111-2, L.121-7 of the Consumer Code and Articles 1641 et seq. of the French Civil Code, Source Of Youth Manufacture is liable for hidden defects in products sold on its website. A hidden defect (Art. 1641 Civil Code) is a defect that renders the item unfit for its intended use or so diminishes its use that the buyer would not have acquired it (or would have paid less) had they known of it, and it must not be apparent at the time of sale. The buyer cannot seek remedies for apparent defects visible at sale (Art. 1642 Civil Code). Actions for hidden defects must be brought within two years of discovering the defect (Art. 1648 Civil Code). Under Consumer Code Article L.211-1 et seq., the buyer may be covered by the legal warranty of conformity and has two years from delivery (Art. L.211-12 and Law n°2014-344 of 17/03/2014) to exercise this right (e.g., manufacturing defect or non-conformity with advertised characteristics). Non-exhaustive definition:

  • The item must be fit for the usual purpose of a similar good (Art. L.211-5, 1°).

  • It must match the description given at purchase and possess the qualities presented on the website.

The buyer cannot invoke conformity for apparent defects (Art. L.211-8). The buyer cannot rely on L.217-8 in three cases:

Within the legal framework, the buyer may demand conformity (Art. L.211-8) and choose repair or replacement (Art. L.211-9). If impossible (model discontinued), not feasible within one month of the claim, or causing major inconvenience, the buyer may return the item for a refund or keep it with a price reduction (Art. L.211-10). Rescission or price reduction is limited to the cases listed; rescission is not available for minor defects (Art. L.211-10 al. 5).

Article 16 – Limitation of Liability

Any liability of Source Of Youth Manufacture for direct or indirect damage arising from non-performance or improper performance of a sale/service shall in no event exceed the price of the product or service concerned. This article does not apply to customers who, by virtue of their status, may rely on Article L132-1 of the Consumer Code.

Computerized records kept by each party under reasonable security conditions are admissible as proof of communications, contracts, and payments between the parties.

Article 18 – Personal Data

Information requested from the customer is necessary to process the order and may be shared with contractual partners involved in fulfillment. Unless expressly objected to, the buyer consents to the use of their personal data for the seller’s customer file and to its disclosure to third parties with whom a contractual relationship exists.

Article 19 – Promotional Codes

Article 20 – Mediation

Under the Decree of 30 October 2015 on consumer dispute mediation (transposing Directive 2013/11/EU and Ordinance n°2015-1033), professionals must offer a mediation procedure in case of dispute with consumers. These Terms are governed by French law. In case of dispute, please first contact Source Of Youth Manufacture to seek an amicable resolution.

Failing amicable settlement, any dispute relating to the formation, performance, or termination of contractual obligations shall be submitted to the Commercial Court of Bourg-en-Bresse (France) in whose jurisdiction the seller’s registered office is located, or to the court of the buyer’s domicile (district or high court), regardless of place of delivery.
